HIPAA and AI: scope and evidence checklist

A healthcare AI workflow can raise privacy and security questions, but HIPAA does not apply to every organization or dataset. Establish the entity’s role and information flow first.

Define the boundary

Identify the covered entity or business associate, system owner, data involved and services receiving it. Have a qualified reviewer decide whether HIPAA applies to this workspace.

Connect evidence to requirements

If declared applicable, Fencia exposes mapped requirements. People can link policies, access records, risk analyses and other evidence, then record what remains missing.

Keep assessment human

Fencia does not scan documents against HIPAA or determine legal applicability. Its readiness view reflects linked evidence and decisions, not verified compliance.

Example: a clinical note assistant

A clinic considers an AI assistant that summarizes patient notes. Before adding a HIPAA checklist, the clinic documents who operates the tool, which patient information reaches it, whether a vendor receives that information and the relevant agreements and access controls. The reviewer decides which requirements apply. In Fencia, the team can link its own evidence to the mapped requirements and record a decision, but the map cannot establish that the vendor or clinic is compliant.

Questions for the responsible reviewer

  • Is the organization a covered entity or business associate in this workflow?
  • What protected health information reaches the AI system or its vendors?
  • Which agreements, risk analyses, access controls and incident procedures are available as evidence?
  • Who validated the applicability decision and when will it be revisited?

Common questions

Does using AI in healthcare automatically trigger HIPAA?
No. The organization's role and the information involved matter. A qualified privacy or legal reviewer should determine applicability rather than relying on a product label.
Will a Fencia score show HIPAA compliance?
No. The workspace shows an internal evidence state based on linked records and human decisions. It is not an audit, legal conclusion or certification.
